Cyber Warfare and International Law – Looking Back at 2020

The Tallinn Manual, published to apply laws of armed conflict to cyber, is a good start to understand how the Law of Armed Conflict pertains to Cyber War. However, it does not address the nuanced problems that governments and corporations face when responding to a cyber attack. Corporations, for example, can be hacked at any moment, but face challenges because they may not be able to respond, except through the government. This panel of seasoned professionals will discuss potential international and domestic laws that could allow private sector corporations to respond, even it just verbally, to such attacks. Panelists will also touch on the fact that experts are hoping that the Tallinn Manual 2.0 further addresses these nuanced issues, despite this manual being complicated and stymied on various political factors.
